Learned advocate appearing for the petitioner submits that the petitioner complied with two notices under Section 41A of the Criminal Procedure Code. The principal accused was granted bail by the jurisdictional Court.

Learned advocate appearing for the State submits that the petitioner is one of the persons who impersonated a living person, took out documents suggesting that such person was dead and executed the registered deed transferring the immovable properties belonging to such person. There are materials in the case diary implicating the petitioner. The petitioner claims himself to be the power of attorney holder of one Durgadas Mukherjee.

In the facts of the present case, the need for custodial interrogation of the petitioner cannot be overlooked.

In such circumstances, we are not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 4494 of 2022 is dismissed.
