By this writ petition, petitioner has challenged the registration of legality and validity of the gift deed in question.

Learned advocate appearing for the respondent nos.5 and 6 in opposing the writ petition submits that this writ petition should not be admitted on the ground of suppression of material fact that the impugned gift deed was already subject matter of challenge in a civil suit filed by the petitioner himself which was dismissed on 17th February, 2023 by the learned Single Judge (Junior Division) at Baruipur Second Court in Title Suit No.429 of 2022.

Considering the facts and circumstances of the case and submission of the parties that the dispute raised in this writ petition is purely civil in nature and

matters of evidence and further on the ground of suppression of material fact, this writ petition being WPA 21093 of 2023 is dismissed.
