The petitioners pray for expeditious disposal of an application filed under Section 151 of the Code of Civil Procedure in connection with Title Suit No.505 of 2021. The suit is pending before the learned Civil Judge (Junior Division), 2nd Court at Hooghly.

Although the petitioners are the defendants in the suit, the application was filed for certain reliefs. Whether the petitioners are entitled to the reliefs claimed in the said application, will be decided in accordance with law and on its own merits upon contested hearing. But a prayer for expeditious disposal of the said application is innocuous. Thus, this revisional application is not required to be served upon the opposite party.

The learned court below shall dispose of the said application within a period of two months from the next date fixed upon allowing the opposite party an opportunity to file written objection, if not already filed. The matter shall be heard and disposed of on contested hearing.

This Court has not expressed any opinion on the merits of the said application. This order shall not be

construed as an opinion of the court either on the maintainability of the said application or on the rights of the petitioners to the relief claimed in the said application. Accordingly, the revisional application is disposed of. All the parties are directed to act on the basis of the server copy of this order.
