CAN 1 of 2021 is an application for a direction upon the respondent no. 6, i.e., the District Panchayat and Rural Development Officer to extend the benefits of the Memoranda dated September 16, 2011, May 20, 2013, February 25, 2016 and February 8, 2019.

The petitioner had filed WPA 20192 of 2015 challenging an order denying regularization. The petitioner was working as a valve operator in a scheme under the Lalgola Panchayat Samiti. As the writ petition was kept pending for a considerable period of time, the petitioner came to know about the policy of the Government of West Bengal to allow certain benefits to those casual/daily rated/contractual/temporary workers, who had been

engaged in government establishments and local bodies.

Under such circumstances, the writ petition is disposed of directing the District Panchayat and Rural Development Officer, Murshidabad to treat the CAN 1 of 2021 as a representation of the petitioner and pass a reasoned order upon taking into consideration the length of service of the petitioner as a casual worker in the panchayat samiti.

Learned advocate for the petitioner shall represent the petitioner before the concerned authority at the hearing. All relevant document shall be filed. Thereafter, a reasoned order shall be passed and communicated to all.

A copy of CAN 1 of 2021 along with a server copy of this order be served upon the concerned authority for necessary compliance of this order. In the event, it is found that the memoranda mentioned hereinabove are applicable in case of the petitioner, necessary steps shall be taken for implementation thereof.

Accordingly, the writ petition is disposed of, with the disposal of CAN 1 of 2021.

The entire exercise shall be completed within a period of two months from the date of communication of this order.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
