Petitioner is aggrieved by the order passed by the Superintendent of Police, DIB, Ranaghat Police District wherein by a communication dated 27.08.2025 it was informed to the petitioner that as per current assessment, no security personnel can be provided to the petitioner.

Learned advocate appearing for the State has submitted a report prepared by the Superintendent of Police, DIB, Ranaghat Police District which reflects as follows:- "6. Present Status Since the withdrawal of her security in March 2023, no incidents have occurred that would justify reinstating the same. Police stations have standing instructions to take

immediate preventive and legal measures as necessary to maintain law and order."

Mr. Das, learned advocate appearing for the petitioner refers to Kalyani PS Case No. 431/25 dated 04.05.2025 which was registered for investigation on the basis of complaint of the present petitioner. The sections under which the said case was registered are Section 126(2)/115(2)/74/79/351(A)(ii) of BNS, 2023.

Since the report of the Superintendent of Police reflects that no incident has occurred and an FIR has been enclosed which reflects that the petitioner had to set the criminal law in motion, I am of the view that the Superintendent of Police, DIB, Ranaghat Police District will revisit his earlier order for not providing security to the petitioner. It is hereby clarified that before passing any further order within a period of 15 days from the date of communication of this order a hearing may be afforded to the petitioner and the petitioner be allowed to produce all the documents in her custody. After hearing, the Superintendent of Police would be at liberty to pass necessary orders preferably within a fortnight from the date of completion of hearing. Consequently, the earlier order which was passed

vide memo no. 3076/DIB, RPD dated 27.08.2025 is hereby set aside.

With the aforesaid observations WPA 21173 of 2025 is disposed of.

Report submitted by the State be kept with the record.
