The writ application has been preferred praying for revocation of the notification dated 19.11.2024 by which the petitioner's case before the 7th Industrial Tribunal has been transferred to the Industrial Tribunal.

It is submitted by the learned counsel for the petitioner that on several occasions the petitioner has approached this Court for expeditious disposal of the said case but due to absence of the Presiding Officers in the Tribunal, the petitioner's case has not been disposed of.

It is submitted that the case of the petitioner has now been transferred from the 7th Industrial Tribunal to the 1st Industrial Tribunal, Kolkata, who is now vacant (no regular Presiding Officer).

It is submitted that there is no Presiding Officer at the 1st Industrial Tribunal, West Bengal and the petitioner is thus being severely prejudiced, considering that his case is of the year 2020.

Learned counsel for the petitioner further submits that the case has progressed substantially and prays that the matter may be retained before the 7th Industrial Tribunal who may be directed to dispose of the case expeditiously.

Considering the said facts and the fact the transferee Court being vacant till date, Case VIII10/2020 be retained in the file of learned counsel 7th Industrial Tribunal who shall make all endeavour to dispose of the case preferably within a period of three months from the date of this order.

Writ application is disposed of.
