The petitioner is a D.El.Ed. College. By an order dated July 29, 2017 National Council for Teacher Education refused to grant recognition to the said college on the ground that the institution was deficient on the following grounds :- "In response, the institution submitted two representation dated 07.04.2017 & 13.05.2017 with some documents. The ERC considered the matter and observed that the institution is still deficient on the following grounds :

(i) No Objection Certificate not issued by the concerned affiliating body.

(ii) The institution has not submitted building plan mentioning total built up area and approved by Govt. Engineer/Authority.

(iii) Building completion certificate is not in the prescribed formal and not signed by the competent Govt. Engineer/Authority.

(iv) The institution submitted single application for D.El.Ed.

programme which does not come under the category of composite institution."

Mr. Mishra, learned advocate appearing for the petitioner submits that the aforementioned deficiencies have now been cured by the college. The Council is not, however, accepting any online application for which the college could not apply for renewal of its affiliation. He has drawn attention of this Court to an order dated August 24, 2022 passed by Delhi High Court in W.P. ( C ) 2813/2021 to suggest that by the said order, Delhi High Court has already directed the National Council for Teacher Education to open the online portal within two weeks from the date of the order.

Mr. Nandy, learned advocate representing National Council for Teacher Education submits that the portal to accept online application has not yet been opened in terms of NCTE (Recognition Norms and Procedure) Regulations, 2014. He submits that when the online portal inviting application for granting recognition will be operational, the petitioner may apply for its recognition.

Mr. Nandy also submits that this writ petition may be disposed of in terms of an order dated June 13, 2022 passed by this Court in WPA 6744 of 2022 (S.A.K. Primary Teacher's Training Institute Vs. National Council for Teacher Education & Ors.).

In that view of the matter, this writ petition is disposed of granting liberty upon the petitioner to apply for recognition of the college as and when the respondent nos. 1 to 3 opens the portal for online application.

WPA 20463 of 2018 is disposed of.
