1. Appeal is directed against refusal to pass ex parte DL-2 04.11.2025 Court No.37 [Bench ID-266362] (AD) ad interim injunction in TS COM 21/2025.

2. Learned Senior Advocate appearing for the appellant submits that, a direction may be issued for expeditious disposal of the pending injunction application.

3. Learned Senior Advocate appearing for the respondents submits that, although, the injunction petition was not served within the returnable date, he is willing to file his written objection within two weeks from date.

4. In the facts and circumstances of the present case, it would be appropriate to request the learned Judge in seisin of the suit to hear and

decide the application for injunction as expeditiously as possible and preferably within six weeks from the next date fixed.

5. Written objection to the injunction petition may be filed within a fortnight from date as prayed for. Reply thereto, if any, within a week thereafter.

6. We are informed that the next date is fixed on December 3, 2025.

7. Since the respondents are represented before this Court and since it is assured that the respondents will appear before the jurisdictional Court, it would be appropriate to request the learned Judge to hear and decide the application for injunction within six weeks from December 3, 2025 without affording any unnecessary adjournment to any of the parties.

8. We make it clear that we did not enter into the merits of the case of the respective parties. All points raised by the parties are kept open.

9. AO-COM 44 of 2025 and IA No.: CAN 1 of 2025 are disposed of accordingly.
