that the petitioner is in custody since 5th January, 2025 and similarly placed accused person has already been granted bail. It has also been submitted that there is no chance of the trial progressing as some of the accused persons are absconding and the prosecution has relied upon 21 witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail and submits that there were major injuries in the body of the deceased which would reflect from the postmortem report. The deceased was lastly residing at the matrimonial home and her body was recovered from an abandoned field and no plausible explanation was offered from the inmates of the matrimonial home.
Be that as it may, since some of the accused persons are absconding, I direct the learned court in seisin of the case to exhaust the process, split up the case against the absconding accused persons and commit the case to the court of sessions for proceeding in accordance with law.
