None appears on behalf of the respondent nos. 2, 3, 4 and 5, despite service.
The petitioners refer to a communication dated 17th March, 2017 by the Executive Engineer-II, New Town Kolkata Development Authority to the Additional General Manager (Engineering) NBCC Ltd., wherein a clarification has been sought for in respect of the unauthorized construction, illegal occupation and sanctioned site plan violation in NBCC Vibgyor Towers, New Town, Pin-700156.
As there was no reply from the end of the NBCC Ltd. a further letter was given on 19th April, 2017 whereby 15 days' time was granted for clarifying, failing which appropriate step was to be taken as per Rules.
The petitioner complains that since thereafter no steps have been taken by the New Town Kolkata Development Authority in respect of the unauthorized construction, illegal occupation and sanctioned site plan violation.
As it appears that the New Town Kolkata Development Authority is already aware of the alleged unauthorized construction, illegal
occupation and sanctioned site plan violation and notices were duly issued to the NBCC Ltd., the instant writ petition is disposed of by directing the New Town Kolkata Development Authority to take appropriate steps as per Rules to deal with alleged unauthorized construction, illegal occupation and sanctioned site plan violation.
Necessary steps shall be taken by the respondent no. 1 within a period of three months from the date of communication of a copy of this order.
The steps taken by the respondent no. 1 shall be communicated to the petitioner for information and necessary action.
WPA 19419 of 2019 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
