Learned advocate appearing for the petitioner submits that petitioner has been unnecessarily implicated in connection with the instant case and the subject matter of the case relates to recovery of Cough-Syrup. Petitioner is in custody for 1 year and till date charge has not been framed.
Learned advocate for the State submits that there is recovery of 14,375 bottles of Phensedyl Cough-Syrup. Petitioner happens to be the owner of the vehicle and was conscious regarding the transhipment which was taking place. Having considered the huge volume of recovery, I am of the view that the provisions of Section 37 of the NDPS Act is attracted.
Accordingly, CRM (NDPS) 1117 of 2025 is dismissed. Learned Trial Court would take steps for expediting the process of trial so that the same is concluded within the reasonable period of time.
