Petitioner has approached this Court being aggrieved by the notice issued under Section 35(3) of the BNSS, 2023 in connection with Chinsurah Police Station Case No.326 of 2025 dated 18.08.2025. The said case has been registered under Sections 353(1)(b)/353(2)/352 /356(2) of the BNSS, 2023. I have considered the letter of complaint which is the genesis of the present FIR.

Having regard to the same, I am of the opinion that the physical appearance before the investigating agency may not be required. However, the petitioner will cooperate with the investigating officer through virtual mode. I direct that no coercive steps be taken against the petitioner in view of the nature of the FIR, provided the petitioner cooperates with the investigating agency. I have taken into

account the nature of the prayers in the writ petition. Further pendency of the writ petition is unwarranted. The investigating officer of Chinsurah P.S. Case No.326 of 2025 would take the investigation of the case to its logical conclusion.

With the aforesaid observations, WPA 21135 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
