The status report filed on behalf of the State as also separately filed by the CID are also taken on record. Learned advocate appearing for the petitioner submits as follows. The petitioner's father was brutally murdered in the midnight on 23.08.1994. On 24.08.1994 Raidighi PS Case No.38/94 was started. On 27.10.97 a final report was submitted. Thereafter a further investigation was conducted. On 21.05.2021 a final report was again submitted.
In 2019, an application was made under the RTI Act to collect documents in respect of the murder case. First, the petitioner's mother filed a writ petition. During the pendency, she passed away. Now, the petitioner has filed an application in this regard. Learned advocate for the State relies on the report and submits as follows. Several documents pertaining to the investigation of the murder case that took place in the year 1994 have become untraceable.
documents including the FIR, the first final report dated 24.08.1994, the second final report dated 27.10.1997 are available and the same are being filed along with the report.
Let copies of the FIR and the two final reports be supplied to learned advocate for the petitioner along with the report in Court.
Other records like the post-mortem report and the forensic report are not available. The petitioner ought to have prayed for the same earlier and not after about 25 years of the death of the victim.
Since much of the grievances of the petitioner have already been redressed, no further order need be passed in this regard.
With these observations, the writ petition is disposed of.
