The defendant in a suit for declaration of title and permanent injunction has filed the instant application under Article 227 of the Constitution of India praying for expeditious hearing of Title Suit No.100 of 2013 pending before the learned Civil Judge (Senior Division), 2nd Court at Barasat.

In view of the order sought and proposed to be passed, there is no necessity of issuing any notice upon the opposite party. However, the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party and/or the learned advocate representing the opposite party in the court below.

It appears from the order sheet that September 19, 2018 was fixed for further evidence of DW1.

It has been submitted by the learned advocate for the petitioner that the evidence could not proceed further due to the pandemic. It has been further submitted by the learned advocate that the learned court below has started taking up matters for final hearing including witness action.

In view thereof, the learned Civil Judge (Senior Division), 2nd Court at Barasat is requested to make all endeavours to dispose of the suit as expeditiously as possible and preferably within a period of six months from date of communication of this order to the learned court below With the above directions CO No.3491 of 2018 is disposed of without any order as to costs.

Photostat certified copy of this order if applied for be supplied to the parties upon compliance of all formalities.
