In terms of the order dated 3rd September, 2024, a report in the form of affidavit affirmed on 20th September, 2024 is filed on behalf of the West Bengal Central School Service Commission and the same is taken on record.

On perusal of the report, it appears that petitioner made application on Utsashree portal on 7th February, 2022 seeking transfer on medical ground and on 3rd March, 2022, transfer application of the petitioner was appraised and list had to be prepared in terms of merit since apart from the petitioner, there were other candidates who applied for transfer to the identical post in Rishra Brahmananda Keshab Chandra High School, District Hooghly. On preparation of list, petitioner ranked 7th. That

being the reason, petitioner could not be transferred to the preferred school.

In view of disclosure of facts in paragraph 3 of the report, no relief can be granted to the petitioner. Accordingly, the writ petition stands dismissed. However, this order shall not preclude petitioner to make application for transfer in future in accordance with law, if situation so arises.

There shall be no order as to costs.

Urgent Xerox certified copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Saugata Bhattacharyya, J.)
