1. Affidavit of service filed by the petitioner is taken on record.

2. The parties are represented through their respective learned counsel.

3. In this PIL, the petitioner has prayed for following relief:

(A) A Writ in the nature of Mandamus directing the respondent authorities specially the respondent nos.2 herein to issue stop work notice in respect of the ongoing illegal work of construction as initiated by the private respondents being the respondent 7 & 8 upon the said plot of land for the interest of public at large.

(B) A writ in the nature of Mandamus directing the respondent authorities specially the respondent no.2 herein to initiate the demolition proceeding in respect of the unauthorized and illegal construction initiated and made by the private

respondents being the respondent no.7 and 8 herein upon the 'said plot of land' pursuant to the complaint/representation dated 11/08/2025 made by the petitioner for the interest of public at large.

(C) A writ in the nature of Mandamus directing the respondent authorities specially the respondent no2 to demolish the unauthorized and illegal construction made by the private respondents being the respondent no.7 and 8 herein upon the said plot of land for the interest of public at large.

(D) A writ in the nature of Certiorari commanding the respondent authorities to transmit all relevant record of the instant case before the Hon'ble Court so that conscionable justice may be administered by quashing the same."

4. The petitioner's grievance is with regard to an illegal construction made in Barga land being R.S. Dag No. 558 corresponding to L.R. Dag No.644 in Mouza Gangarampur, P.S. Uluberia, which has been classified as Sali land without having any sanctioned building plan. The petitioner has already made representation before the Chairman, Uluberia Municipality/Respondent no.2 dated 11.08.2025.

5. The respondent no.2 is directed to consider the said representation within 60 days from today in

accordance with law, upon affording proper opportunity of hearing to the petitioner and pass a reasoned order and communicate the same to the petitioner.

6. Accordingly, the PIL stands disposed of. It is needless to mention that if the construction on the Barga land which has been classified as Sali land and illegal construction is being raised on it, then respondent no.2 shall take appropriate steps forthwith in accordance with law.
