Affidavit of service filed in Court is taken on record. The petitioner seeks transfer in terms of the order dated 11th March, 2020 issued by the Joint Secretary, Government of West Bengal, Elementary Education Branch for home district transfer.
The home district of the petitioner was erroneously recorded in his service records. The proper home district of the petitioner is Purba Medinipur. The same was erroneously noted as Paschim Medinipur. Because of the wrong noting of the home district, the petitioner cannot avail the benefit of the home district transfer order that has been passed by the authority.
Necessary correction in the service records of the petitioner has been made. The corrected record has been
forwarded by the District Inspector of Schools, Primary Education, Jhargram to the Deputy Director of School Education, (Rural Primary) in December 2020.
The petitioner presently seeks transfer to his home district. His application is pending consideration before the Secretary of the West Bengal Board of Primary Education.
Without going into the merits of the said application, the writ petition is disposed of by directing the Secretary, West Bengal Board of Primary Education to take a decision on the said application in accordance with law at the earliest but positively within a period of ninety days from the date of communication of this order. A reasoned order shall be passed and communicated to the parties immediately thereafter.
Learned advocate for the petitioner shall forward a copy of the application seeking transfer along with all other supporting documents to the aforesaid respondent at the time of communication of this order.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
