The petitioner seeks higher scale of pay on and from the date of her appointment.

It appears that the issue was taken up for consideration by the District Inspector of Schools (SE), Kolkata and hearing in terms of an order of this Court dated February 22, 2023 passed in WPA No.93 of 2021 was scheduled on April 5, 2023. The fate of the hearing has not been made known to the petitioner.

Without entering into the merits of the claim of the petitioner, as it appears that the issue was under active consideration by the DI of Schools, accordingly, the authority ought to have passed a final order in the matter. Nearly three years have elapsed from the date of the previous order passed by the Court.

In view of the above, the instant writ petition is

disposed of by directing the concerned DI of Schools to take steps in light of the order passed by the Court on February 22, 2023 in WPA No.93 of 2021 by passing a final order at the earliest but positively within a period of eight weeks from the date of communication of this order. The final order shall be communicated to the parties immediately thereafter.

If required, fresh hearing to adjudicate the issue may be conducted by the DI.

Affidavit of service filed in Court be taken on record.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
