The defendants in a suit for declaration of title and permanent injunction have filed the instant application under Article 227 of the Constitution of India praying for expeditious disposal of Title Suit No.18929 of 2012 pending before the learned Civil Judge (Junior Division), 3rd Court at Alipore.

This Court is informed by the learned advocate for the petitioners that the learned Courts below have started taking up the matters for final hearing including the witness action.

The learned advocate for the petitioners submits that a date has been fixed sometimes in the month of January 2021 for evidence of the plaintiff witness no.1.

Since the suit is pending from 2012, the learned Civil Judge (Junior Division), 3rd Court at Alipore is requested to make all endeavours to dispose of the Title Suit No.18929 of 2012 as expeditiously as possible and preferably within a period of one year from the date of communication of this order without granting any unnecessary adjournment to either of the parties.

With the above directions CO No.3521 of 2018 is disposed of without any order as to costs.
