And In the matter of: Sakoyat Mondal @ Saukat Pramanik ....Applicant/Petitioner Ms. Busra Khatun ...for the petitioner Mr. Bibaswan Bhattacharya Ms. Suruchi Saha ..for the State Learned counsel appearing on behalf of the petitioner submits that apart from the statement of co-accused which is inadmissible in evidence, there are no other incriminating materials available in the case diary against the present petitioner.

Learned counsel appearing on behalf of the State files a report which is taken on record. He relies on the case diary, the report and submits as follows. The FIR was lodged against the petitioner and others in November 2023. But, the petitioner remained absconding. After submission of charge sheet, warrants were issued and were kept pending. Finally, a proclamation was issued. In view of the same, the application for anticipatory bail may not be entertained. Considering the materials available in the case diary, the restriction contained in Section 37 of the NDPS Act, the fact that proclamation has already been issued against the petitioner in this case where the FIR registered in November 2023 had named the present petitioner, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
