This is an application under Article 227 of the Constitution of India.

The Order No.03 dated August 03, 2024 passed by the 1st Court of the learned Additional District Judge, Motor Accident Claim Tribunal, Durgapur, District : Paschim Bardhaman in MAC Case No. 115 of 2024 is under challenge.

The learned Tribunal by the order impugned has dismissed an application under Section 166 of the Motor Vehicles Act, 1988 as not maintainable, the said order is open to appeal under Section 173 thereof. The revisional application is not maintainable, C.O. 3090 of 2024 is dismissed as such without any order as to costs.

Liberty, however, is granted to the learned advocate-on-record for the petitioner to take back the certified copy of the order impugned upon furnishing a photocopy thereof.

Urgent Photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
