By reason of a typographical error in the cause title of the order dated 12th December, 2024, the number of the matter has been incorporated as 'WPLRT 128 of 2006' in place and stead of 'WPLRT 128 of 2024'.

Office is directed to effect necessary correctioned in the said order.

Mr. Manna, learned advocate appearing for the petitioner submits that by an order dated 5th July, 2024, the final hearing of the original application (in short, OA) being O.A. 1475 of 2024 has been deferred and fixed about a year thereafter on 14th July, 2025. Such delay in fixing a date for hearing is too long in a system where justice is supposed to be swift but deliberate.

Mr. Siddiqui, learned additional government pleader enters appearance on behalf of the State respondents and Mr. Pahari, learned advocate enters appearance on behalf of the private respondent nos. 6 to 15.

We have heard the learned advocates and considered the materials on record.

It is for the learned Tribunal to regulate its own procedures in respect of the cases on Board for effective disposal and to ensure that the cases are disposed of within a reasonable period of time. Whether in the facts and circumstances of the case any early date of hearing is required to be fixed for expeditious disposal of the OA, needs to be considered by the learned Tribunal at the first instance.

In view thereof, the writ petition is disposed of with liberty to the petitioner to file an application for preponment of the date of hearing of the OA before the learned Tribunal.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
