Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 100 bottles of Phensedyl and the petitioner has been arrested on the basis of statement of co-accused.

It is contended that the petitioner is in custody for six and half months and only charge sheet has been submitted and charges have been framed, as such further detention of the petitioner is unwarranted.

Learned advocate for the State opposes the prayer for bail and submits that the petitioner has antecedents and as such he was shown arrested in connection with the instant case.

I have taken into account the materials appearing against the present petitioner and having considered the period of detention, I am of the view further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Dilwar Ali @ Dilur Hossen @ Dilbar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge under NDPS Act, Dakshin Dinajpur at Balurghat.

If on bail, petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1118 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
