Learned advocate for the respondent no.5, on the other hand, submits that the respondent no.5 is a bargardar, as such, he has right to enter the property.

State has submitted a report which reflects that the police authorities are well aware regarding the nature of the dispute existing between the petitioners

and the private respondents. The report also reflects that a civil suit being TS 392 of 2023 is pending before the learned Civil Judge (Jr.Divn.), 1st Court, Midnapore, wherein an ad interim order has been passed in favour of the petitioner.

In view of the nature of the dispute existing between the petitioners and the private respondents, I direct the Officer-in-charge of Kharagpur (L) Police Station to keep a strict vigil as also ensure that no untoward incident results because of the strained relationship existing between the present petitioners and the private respondent nos. 5 and 6.

In case, there are situation which calls for interference, the police authorities would check whether any cognizable and/or non-cognizable offence has been committed, thereafter, proceed in accordance with law.

With the aforesaid observations, WPA 21423 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
