The petitioner is aggrieved that State is not giving permission to hold a demonstration and/or protest in submitting a representation to the Assistant Labour Commissioner.

Counsel for the State submits that the State has absolutely no objection to the petitioner's holding any rally. However the places proposed by the petitioner and the route for holding procession and/or mass rally at 10:00 A.M. in the morning tomorrow is likely to very seriously disrupt the traffic on a working day at peak hours.

It is further submitted by Mr. Saha, that a designated place shall be indicated by the police where the petitioner may hold a rally. It is also submitted that any 5 to 7 representatives (to be named) of the

petitioner shall be escorted to the Office of the Labour Commissioner to submit a representation.

In view of the above, since the State, in principle, has no objection for the rally being conducted, the instant writ petition shall stand disposed of.

The State shall communicate their conditions and the place of holding of rally and for the petitioner's to assemble, latest by 6:00 P.M. today to their Advocate-on-record by electronic mail. The petitioner shall name their representatives to visit the Labour Commissioner.

There will be no order as to costs.
