However, respondent nos. 2 & 8 are represented by learned advocates.
Mr. Ashit Kumar Chakraborty, learned advocate representing the respondent no. 2, on instruction, submits that sole petitioner has died on 11th January, 2017 and after the death of the petitioner the wife of the petitioner made an application for appointment on compassionate ground and same was allowed thereby appointing the wife of the petitioner. It has further been submitted on behalf of respondent no. 2 that the writ petition has become infructuous.
In view of aforesaid submissions being made on behalf of the respondent no. 2 the writ petition stands dismissed as infructuous.
However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
