Petitioners contend impugned First Information Report was registered after the institution of a complaint case on the self-same allegation.

I have considered the materials on record. Allegations in the FIR show opposite party no.2 married petitioner on 13.12.2021. At the matrimonial home, she was subjected to physical and mental torture and ultimately she was driven out. Her stridhan articles were misappropriated. Ingredients of the offences under Sections 498A/406 of the Indian Penal Code are disclosed in the FIR.

Hence, I am not inclined to quash the proceeding. However, as per Section 210 of the Code of Criminal Procedure (Section 233 of the BNSS), Complaint case is to remain stayed till disposal of the investigation. It is open to the petitioner to pray for amalgamation of two criminal cases in terms of the aforesaid provision of law before the jurisdictional Court. 4.

With this liberty, revision petition is disposed of. 5.

Urgent photostat certified copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
