Learned Counsel for the petitioner prays for quashing of the impugned proceeding.

I have examined the impugned FIR as well as charge-sheet. Petitioner was married to opposite party no. 2 on 09.12.2013. It is alleged in the impugned FIR petitioner demanded a flat and over this issue opposite party no. 2 was subjected to mental and physical torture and driven out from her matrimonial home in 2000. Materials on record prima face disclose ingredients of alleged offence. I am not inclined to interfere with the impugned proceeding. It is open to the petitioner to agitate his defence in accordance with law at the appropriate stage of the proceeding.

Accordingly, the application is disposed of.
