1. The affidavit-of-service filed in Court today is taken on record.
2. The writ petition has been filed, inter alia, praying for a direction upon the respondents to carry out mutation and/or mutate the name of the petitioner in respect of the premises No. 23/37, Gariahat Road, Golpark, Kolkata 700029.
3. Mr.
Banerjee, learned senior advocate representing the petitioner would submit that despite the fact that the petitioner had applied before the respondents for mutating its name, the same has not been done.
4. Mr. Mukherjee, learned advocate representing the municipality on the other hand would submit that the writ petition filed by the petitioner does not disclose form A42 and as
WPA 21481 of 2025 such in absence of form A42, the municipality could not proceed with the mutation.

Having heard the learned advocates and though several allegations and counter allegation have been made as regards the filing of an application in form A42, I am of the view that it shall be prudent at this stage to dispose of the writ petition by permitting the petitioner to once again apply before the municipal authorities in accordance with the procedure laid down by filing an application in form A42. If such application is filed within a period of 2 weeks from date, the municipality shall upon giving an opportunity of hearing to the parties decide on the petitioner's application in accordance with law by passing a reasoned order. It is expected that the decision in this regard shall be taken by the municipality within a period of 4 weeks from the date of filing of the application.
6. With the above observations and directions, the writ petition is disposed of.
