Mr. Shourjyo Mukherjee Mr. Vishwarup Acharyya Ms. Anindita Chattopadhyay ....for the petitioners This application under Article of the Constitution of India is at the instance of the defendant Nos.19 and 21 praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Contai to dispose of the pending applications in Title Suit No.391 of 2014 expeditiously.
The learned advocate appearing for the petitioner submits that several interlocutory applications are pending for hearing.
In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or his learned advocates representing the opposite parties before the learned trial judge.
From the order sheets appended to this application, this Court finds that November 13, 2025 has been fixed
for hearing of the petitions dated April 16, 2025, April 23, 2025, June 16, 2025 and July 14, 2025.
In the light of the submission made by the learned advocate for the petitioner, CO 3341 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 1st Court at Contai to make an endeavour to dispose of the aforesaid pending applications filed in Title Suit No.391 of 2014 as expeditiously as possible but preferably within a period of three months from the next date fixed without granting any unnecessary adjournments to either of the parties.
After disposal of the interlocutory applications and after the suit is made ready for hearing, the learned trial judge is requested to make an endeavour to dispose of the Title Suit No.391 of 2014 as expeditiously as possible but preferably within a period of one year after the suit is made ready for hearing. This order is passed taking note of the fact that the suit is pending from the year 2014. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
