The order dated February 25, 2016 is recalled. Hence, CAN 2394 of 2016 is restored to its original file and number.

Accordingly, CAN 2394 of 2016 is allowed and disposed of.

WPA No. 21017 of 2008 It appears that the petition has become infructuous because the standard of Weights & Measures (Enforcement) Act, 1985 has been repealed and replaced by the Legal Metrology Act, 2009.

Hence, WPA 21017 of 2008 shall stand dismissed as infructuous with liberty, however, reserved to the petitioner to agitate the cause of action under the new statute, if otherwise maintainable.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
