This application under Article 227 of the Constitution of India is at the instance of the plaintiffs and praying for a direction upon the learned Additional Civil Judge, Junior Division, 1st Court at Diamond Harbour to dispose of the Title Suit No. 10 of 2021 expeditiously.

Learned Advocate appearing for the petitioners submits that the issues have already been framed and 11st September, 2025 has been fixed for peremptory hearing of the said suit. In view of the order sought and proposed to be passed, there is no necessity to serve a notice upon the opposite party. However, learned Advocate on record for the petitioners shall be obliged to forward a copy of this application along with this order to the opposite parties/learned Advocate representing the opposite parties before the learned Trial Judge. From the order sheets appended to this application, this Court finds that September 11, 2025 has been fixed for hearing of the suit.

In the light of the submissions made by learned Advocate for the petitioners, CO. No. 3336 of 2025 is disposed of by requesting the learned Additional Civil Judge, Junior

Division, 1st Court at Diamond Harbour to take up the hearing of the Title Suit No. 10 of 2021 on the next date fixed i.e., on September 11, 2025 if the same is otherwise ready for hearing and make all endavours to dispose of the appeal as expeditiously as possible without granting unnecessary adjournments to either of the parties.
