Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of informing the Officer-in-Charge, Coke Oven Police Station and the Commissioner of Police, Asansol-Durgapur Police Commissionerate, no steps have been taken. Learned advocate for the petitioner submits that 35 lakhs rupees have been paid to the private respondent nos.4 and 5 and in spite of payment of such money, the chain of documents reflect that the property did not belong to the respondents.

State has submitted a report. Report reflects that a civil suit is pending.

Be that as it may, I find from the complaint and in the conveyance, the consideration money has been differently expressed. Having regard to the same, I am of the view that the present petitioner requires explanation for the same. Consequently, the petitioner would in the circumstances approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate will assess and ascertain regarding the genuinity of the accusations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid directions, WPA 21284 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
