Halder, Mr. Indranil Halder ...for the Petitioner Mr. Debanjan Mukherji ...for CESC The petitioner, by filing this writ petition, challenges 11-09-2025 AKG Ct. 15 the final order of assessment dated August 19, 2025, which requires him to deposit a sum of ₹79,305/- on the allegation of unauthorized use of electricity. The present writ petition was filed before this Court on September 8, 2025.

Mr. Bidyut Halder, learned counsel appearing for the petitioner, submits that the petitioner was asked to sign certain documents without any opportunity to peruse the same and, accordingly, he signed all of them. However, it is his contention that the load taken into account while passing the final order of assessment is not correct. In my view, all such grievances can appropriately be raised by the petitioner in an appeal under Section 127 of the Electricity Act, 2003.

Considering that the writ petition was filed within the prescribed limitation period of thirty (30) days from the date of the final assessment order, liberty is granted to the petitioner to prefer an appeal before the appropriate

appellate authority within thirty (30) days from the date of this order.

Before the appellate authority, the petitioner shall also be at liberty to make a prayer for restoration of his electricity connection, and the appellate authority shall consider such prayer in accordance with law.

Accordingly, WPA 21480 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
