The petitioner is a retired employee of Garulia municipality. He retired from service in the month of February 2021. His grievance is that he has not been paid his terminal dues.

Learned advocate representing the municipality submits, upon instruction that, the petitioner is a habitual absentee.

It has, however, been submitted that no decision has yet been taken with regard to the payment of the terminal dues of the petitioner.

A representation filed by the petitioner in August 2023 praying for release of terminal benefit is pending consideration before the Municipality.

Without entering into the claim of the petitioner with regard to the entitlement of his terminal dues, the instant writ petition is disposed of by directing the Chairman, Garulia municipality to consider and dispose of the representation filed by the petitioner in

accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

In the event the petitioner is found entitled to any due, the same shall be credited in his favour. If the Chairman rejects the claim of the petitioner, then the reasons for rejection shall be intimated to him immediately thereafter.

Learned advocate for the petitioner is directed to forward copy of the representation received by the Municipality on 25th August, 2023 at the time of communicating the order of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
