1. Affidavit-of-service filed in Court today be kept with the records.

2. The petitioner prays for consideration of the legal representation filed on his behalf seeking unlocking of the vehicle which was used for transportation of sand.

3. Learned advocate for the State respondents submits that there are no documents in favour of the petitioner permitting him to transport sand. The report by the Additional District Magistrate and District Land and Land Reforms Officer, Purba Bardhaman produced in Court today mentions that the vehicle of the petitioner was e-locked by the BL&LRO, Khandaghosh. The same was done in accordance with Rule 50(1) of the West Bengal Minor Minerals Concession Rules, 2016.

4. As it appears that the petitioner prays for consideration of the legal representation, accordingly, the instant writ petition is disposed of

by directing the Block Land and Land Reforms Officer, Khandaghosh, the respondent no. 4 herein to consider the prayer of the petitioner in accordance with law and permit the petitioner to place documents in support of his stand.

5. A decision shall be taken in the matter at the earliest but positively within a period of four weeks from the date of communication of this order.

6. The instruction filed by the Additional District Magistrate & District Land & Land Reforms Officer, Purba Bardhaman be retained with the records.

7. As the writ petition is being disposed of without calling for any affidavits, the allegations made therein are deemed not to have been admitted by the respondents.

8. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
