This revisional application has become infructuous in view of the fact that the grievance of the petitioners have partially been addressed. Hence the application is not entertained on merits. The petitioners had filed this application for challenging the inordinate delay on the part of the learned Civil Judge (Senior Division)1st Court, Barasat in deciding an application for repair, filed in connection with Title Suit No. 442 of 2017.

Learned counsel submits that subsequently, the application has been disposed of.

However, this court is of the view that irrespective of the result of the application for repair, the partition suit should be disposed of expeditiously. The suit is of 2017. An order of expeditious disposal will enure to the benefit of all parties. This court has not entered into the merits of the pending suit.

The learned court below shall make sincere effort to dispose of the suit within a year from the date of communication of this order, upon granting opportunity to the parties to contest the proceedings. The revisional application is accordingly disposed of.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
