1. We have heard the learned Counsel for the parties. 2.
The present petitioner is the daughter of the principal accused. It is submitted that the principal accused died on 4th March, 2016.
3. The death certificate produced is taken on record.

The learned Counsel for the State submits that the petitioner has not cooperated with the investigation although notices under Section 41A of the Cr.P.C. corresponding to Section 35(3) BNSS were served upon the petitioner several times. The learned Counsel has also relied upon few bank statements to show transactions between the petitioner and the defacto complainant. 5.
Considering the materials available in the case diary, the nature and extent of complicity of the petitioner in the commission of alleged offence and the bank statements disclosed does not refer to the name of Kajal Kumar Dey or Signed By :

Sasthi Rani Dey, we are of the view that custodial interrogation of the present petitioner is not necessary.

Accordingly, we direct that in the event of arrest, the present petitioner, namely, Sasthi Rani Dey alias Sathi Rani Dey shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The petitioner shall meet the I.O. as and when required following the norms applicable to a woman accused till the submission of the final report. The petitioner shall appear before the learned Additional Chief Judicial Magistrate, Barrackpore, within two weeks from date.

Accordingly, the prayer for anticipatory bail of the petitioner is allowed.
