The core of the disputes raised by the petitioner pertains to highhandedness and the illegality by the concerned Pradhan. It is submitted on behalf of the petitioner that it is the Pradhan who is responsible for the illegal and unauthorized acts in constructing a road. The State is represented and submits that in view of the seriousness of the allegation made against the Pradhan, the matter be referred to the District Magistrate.

In view of the above, WPA No.21890 of 2024 stands disposed of directing the concerned District Magistrate being the respondent no.2 to consider and dispose of the representation dated July 19, 2024 within six weeks from the date of communication of this order and in accordance with law after giving right to all the

affected parties.

It is made clear that there has been no adjudication on the merits of the case and the respondent no.2 is to act strictly in accordance with law without being influenced by any observations made herein and after hearing all the parties.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
