Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of an order dated 19.04.2024 passed by the learned Civil Judge (Junior Division), 2nd Court, Arambagh, Hooghly in T.S. No.133 of 2024, the private respondent no.4 is carrying out and/or pursuing his illegal activities. The order of injunction, in fact, restrains the private respondent no.4 from transferring any portion of the scheduled property or dwelling house in favour of any third party. Petitioner's main contention is that such order is being violated.
Petitioner thereafter approached the learned civil court wherein by an order dated 21.05.2025 has been pleased to pass certain directions upon the police authorities so that the injunction order is not violated.
Having considered the nature of the injunction order, police authorities have hardly any role to play until and unless there is any breach of the peace.
Consequently, in case there is any breach of such order, petitioner would approach the civil court for necessary directions.
However, it is directed that since the petitioner and the respondent no.4 are at loggerhead, in case there is any violation of law and public order, police authorities would ensure that the same is not blown out of proportion.
With the aforesaid observations, WPA 21407 of 2025 is disposed of.
There will be no order as to costs.
