The writ petition is directed against an order dated June 6, 2016 passed by the West Bengal Administrative Tribunal in OA-470 of 2016.

None appears for the respondents despite service. Affidavit of service filed in Court be taken on record.

The writ petition is pending since 2016.

By the impugned order, the Tribunal directed the Director of Health Services to release the private respondent as early as possible to enable him to join the post of Tutor in Cardiology, IPGME&R, Kolkata. Apparently, the application made by the private respondent before the authorities for joining the post of Tutor in Cardiology was not routed through proper channel. He was required to resign his post in the West Bengal Health Services so as to join the post of Tutor in Cardiology which he did not do.

Since, the private respondent is not appearing in the matter, we infer that the private respondent is no longer interested to join as Tutor in Cardiology at Kolkata given the passage of time.

In such circumstances, we set aside the impugned order of the Tribunal dated June 6, 2016.

WP.ST 168 of 2016 is disposed of accordingly. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
