Report submitted by the learned advocate appearing for the State be also kept with the record. Learned advocate appearing for the petitioner submits that in spite of earlier order dated 01.05.2024 passed by this Hon'ble Court in WPA 26989 of 2023, the private respondents being rank outsiders are still interfering with the peaceful enjoyment of the property and also obstructing the petitioner to carry on her cultivation. Learned advocate for the petitioner draws the attention of the Court to the earlier order dated 01.05.2024 passed by the coordinate Bench wherein there was a direction that no untoward incident should occur and in case such incident takes place, petitioner would be at liberty to approach the local police authorities.

State has submitted a report which reflects that a long standing land dispute is existing

between the petitioner and the private respondents. Earlier a case was registered being Pursurah P.S. Case No. 01 of 2025 dated 02.01.2025. On completion of investigation, charge-sheet has been submitted. On receipt of the present information on or about 13.08.2025, police authorities have drawn up proceedings under Sections 126/135(3) of BNSS.

Having considered that the police authorities are well aware regarding the ground reality so far as the dispute between the petitioner and the private respondents are concerned, it would be the duty of the police authorities to ensure that violation of law and order which is a specific complaint of the petitioner is not blown out of proportion. In case such circumstances arise, police authorities will exercise their powers to restrain the parties from commission of any cognizable offence.

With the aforesaid observations, the writ petition being WPA 21404 of 2025 is disposed of. A copy of the report be handed over to the learned advocate appearing for the petitioner. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
