1. Heard the submission of learned advocates appearing on behalf of the petitioner as well as State.

2. The petitioner is in custody for 135 days. The bail application of the petitioner was rejected considering the nature of offence alleged against him. He was in custody since then.

3. The injury report, prima facie shows that operation was done by local quack. Considered the period of detention conclusion of investigation and submission of charge sheet. In this case charge has not yet been framed and the extent of complicity of the accused person and this court is of the view that further detention of the petitioner is not be necessary in this case.

4. Accordingly, petitioner shall be released upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each one of whom must be local, to the satisfaction of the learned ACJM, Kakdwip, 24- Parganas and

on condition that he shall appear before the trial court on every date of hearing and shall not intimidate witnesses nor tamper with evidence in any manner whatsoever and on further condition that the petitioner shall not enter into the jurisdiction of Sagar Police Station until further orders and meet the I.O. of the concerned police station once in a week.

5. In the event the petitioner fails to appear before the trial court, the trial court shall be at liberty to cancel his bail bond without further reference to this Court before the jurisdictional Court on the dates fixed for appearance and in default, the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court

6. Thus, the application for bail in respect of petitioner is allowed.

7. Accordingly, the application being, CRM(M) 1629 of 2025 stands disposed of as allowed.

8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

9. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
