Petitioners are aggrieved by the fact that in spite of ad interim order of injunction passed in Title Suit no. 45/2022 by the learned Civil Judge (Senior Division), 3rd Court, Howrah, the private respondent are interfering with the property of the petitioners as also abusing and threatening them.

Learned advocate for the private respondent nos.6 and 7 disputes and denies the said contention. State has submitted a report. Report reflects that a proceeding has been drawn up under Section 126 of the BNSS.

Since the Civil Court is in seisin of the issue, I am of the opinion that in case of breach of any order passed by the Civil Court, petitioners be well advised to approach

the Civil Court for necessary reliefs. In case any directions are passed upon the police authorities, police authorities would respect, obey and implement the said order.

In the meantime, police authorities would continue their surveillance and ensure that no breach of the peace and/or tranquility takes place.

With the aforesaid observations WPA 21403 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
