Kausik (Allowed) CRM (NDPS) 1123 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1179/2025 dated 27.06.2025 under Section 21(C)/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 145 days and he has been implicated in connection with the instant case on the basis of statement of the principal accused from whom recovery has been effect.

Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that 261 gms. of brown sugar is the subject matter of the case. Learned advocate is unable to rebut the contention that the petitioner has been implicated on the basis of statement of the co-accused. Having considered that neither call data records have been produced in connection with the instant case and/or any

other connection except the statement of the co-accused, I am of the opinion that further detention of the petitioner is unwarranted.

As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Khursed Sk. @ Md. Kused Alam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional District Judge, 4th Court, Special Court, Malda.

If on bail, the petitioner shall once in a week meet with the Investigating Officer o the case and shall not leave the District of Malda without prior permission of the learned Special court.

Accordingly, CRM (NDPS) 1123 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
