(A) No. 4530 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Budge Budge Police Station Case No. 254 of 2022 dated 10.08.2022 under Sections 135/138 of the Electricity Act, 2003. And In Re : Bhaskar Naskar & Anr. ..... petitioners Mr. Pradip Kr. Kundu .....for the petitioners Mr. Kum Kum Mitra ....for the State Ms. Sreyashee Biswas .... For the CESC Petitioners have deposited 50% of the final assessment bill for un-metered consumption.

This is not disputed by the learned Counsel appearing for CESC.

Under such circumstances, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs.2,000/- (Rupees Two Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on condition that the petitioners shall appear before the court below and pray for regular bail within a period of four weeks from date.
