Learned advocate for the petitioner submits that he purchased plots of land and thereafter obtained sanctioned plan and has been raising construction. It has been alleged that the private respondents are trying to dispossess the petitioner from the property and resisting the petitioner from raising said construction. To that effect information was furnished with the police authorities but in spite of the said information no steps have been taken.

State has submitted a report. Report reflects that the respondents have been in possession in some portion of the land which is the genesis of the dispute. It is also admitted that construction of the temple is at the midway, however, the respondents are adamant in demarcation of the property.

Having considered that the genesis of the dispsute is relating to land and the police authorities have already drawn up proceedings under Sections 126/135 of the BNSS, I direct the police authorities to continue their surveillance and ensure that no breach of the peace takes place and/or the situation is not blown out of proportion. With the aforesaid observations WPA 21400 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
