This is an application for expeditious hearing of the miscellaneous appeal pending before the learned Additional District Judge, 5th Court at Alipore.

None appears for the petitioner at the time of call. No accommodation has been prayed for either.

It appears from the record that 2nd September, 2023 was fixed for hearing of the vacating application filed on 27th June, 2023 as well as for hearing on the maintainability of the appeal.

This Court is of the considered view that interest of justice would be subserved if a direction for expeditious disposal of the miscellaneous appeal and the connected application in connection with the said appeal are passed. Accordingly, CO 3055 of 2023 is disposed of by requesting the Additional District Judge, 5th Court, Alipur to take up hearing of the application in connection with the miscellaneous appeal on the date fixed and to make all endeavour to dispose of the application and the miscellaneous appeal as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
