Learned Counsel for the petitioner submits he is not the proprietor of Crystal Enterprise and was not the signatory of the cheque.

This is a question of fact which requires to be agitated in course of trial. Uncontroverted allegations disclose cheque issued by the petitioner was dishonoured and upon notice of dishonor being served the cheque amount remained unpaid. Hence, I am not inclined to interfere with the impugned proceeding.

Liberty is given to the petitioner to agitate the issues raised herein in accordance with law at the appropriate stage of trial.

Accordingly, the application is disposed of.
