Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that, in order to effectuate the electricity connection, four electricity poles need to be installed along a pathway relevant to the proposed connection. A dispute has arisen between the petitioner and Respondent Nos. 11 and 12 concerning this pathway. Respondent Nos. 11 and 12 have raised objections before WBSEDCL regarding the proposed connection in favour of the petitioner. Despite service of notice, Respondent Nos. 11 and 12 remain unrepresented.

Let the affidavit of service filed by the petitioner be kept on record.

In my view, the dispute between the parties concerning the pathway in question ought to be adjudicated by the District Magistrate, South 24 Parganas, pursuant to Rule 3 of the Works of Licensees Rules, 2006.

The District Magistrate is directed to hear the petitioner as well as Respondent Nos. 11 and 12 and to pass a reasoned order within three months from the date of communication of this order.

Accordingly, WPA 21412 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
